DMCA Policy

Digital Millennium Copyright Act Notice

BunnySync ("BunnySync", "we", "us", or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using our website, software, applications, and services (collectively, the "Service").

1. Notification of Claimed Infringement

If you are a copyright owner, or authorized to act on behalf of one, and you believe that copyrighted work has been copied in a way that constitutes copyright infringement occurring on or through the Service, please submit your claim via our contact page, with the following information:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  • Identification of the copyrighted work claimed to have been infringed;
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity, including specific URLs or other information reasonably sufficient to permit us to locate the material;
  • Your contact information, including your address, telephone number, and an email address;
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

2. Counter-Notification

If you believe that material you posted on the Service was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us by submitting written notification to our contact address. Pursuant to the DMCA, the counter-notification must include substantially the following:

  • Your physical or electronic signature;
  • Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled;
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled;
  • Your name, address, and telephone number;
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which BunnySync may be found;
  • A statement that you will accept service of process from the person who provided notification of the alleged infringement or an agent of such person.

If a counter-notification is received by us, we may send a copy of the counter-notification to the original complaining party informing that person that we may replace the removed material or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed material may be replaced, or access to it restored, in 10 to 14 business days after receipt of the counter-notification, at our sole discretion.

3. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, BunnySync has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

5. Modifications to This Policy

BunnySync reserves the right to modify, alter, or update this DMCA Policy at any time. We will notify users of any material changes by posting the new policy on this page with a new effective date. Your continued use of the Service following any changes indicates your acceptance of the new policy.
